§ 7. BIRD SANCTUARY

    A.

    DESIGNATION

    The entire area embraced within the corporate limits of the City of Santa Fe, Texas, is hereby designated as a bird sanctuary.

    B.

    UNLAWFUL TO MOLEST BIRDS

    It shall be unlawful to trap, hunt, shoot or attempt to shoot or molest in any manner any bird or wild fowl or to rob bird nests or wild fowl nests within the city. Provided however, if sparrows, blackbirds, pigeons, crows or similar birds are found to be congregating in such numbers in a particular locality that they constitute a nuisance or menace to health or property, then said birds may be destroyed in such numbers and in such manner as is deemed advisable by and under the supervision of the Chief of Police of the City of Santa Fe, Texas.

    C.

    ABATEMENT OF NUISANCES

    1.

    If European starlings, English sparrows, grackles, ravens, red-winged blackbirds, cowbirds, feral rock doves (Columba livia) or crows are found to be congregating in such numbers in a particular locality within the city, and by such congregating constitute a nuisance or a menace to health or property in the opinion of the city council or of its duly appointed representative, the proper health authority or council shall meet with representatives of the Audubon Society, Bird Club, Garden Club and/or Humane Society, or as many of such clubs as are found to exist in the city, after having given three (3) days' actual notice of time and place for such meeting with representatives of the clubs.

    In the event that as a result of such meeting no satisfactory alternative is found to abate the nuisance, the birds constituting such nuisance may be destroyed in such numbers and in such manner as may be deemed advisable by the health authorities or council under supervision of the chief of police, or such other person as may be appointed by the council to supervise such destruction.

    D.

    PENALTY FOR VIOLATION

    Anyone violating the provisions of this section shall be guilty of a misdemeanor, and upon conviction shall be punished by a fine of not less than twenty-five dollars ($25.00) nor more than five hundred dollars ($500.00).
