§ 25. OBSTRUCTIONS IN PUBLIC RIGHTS-OF-WAY

  • The following are hereby declared to be a nuisance and/or a traffic hazard and the Code Enforcement Officer is hereby empowered to remove same or cause to be moved without notice:

    A.

    OBSTRUCTIONS

    Obstructions of any kind, maintained, constructed, placed, planted, or grown in the right-of-way of any public street, except single tree trunks pruned and trimmed to a height of seven feet (7') above the walk grade and spaced at least ten feet (10') apart; and other plantings trimmed and pruned, so as not to encroach over and into public right-of-way, and so as not to exceed two and one-half feet (2½') in height above the walk grade and except further, all utility poles, street signs, traffic signs, and other devices placed in such areas under lawful authority of the City.

    B.

    SIGNS AND AWNINGS

    Any sign, awning, or other protrusion which hangs over or protrudes over any sidewalk in the City at a height of less than eight feet (8') above the sidewalk.

    C.

    TREES, PLANTS AND SHRUBS

    Any tree, plant, or shrub which hangs over the sidewalk and which is not trimmed to a height of seven feet (7') above said sidewalk, or any tree, plant, or shrub which hangs over any street or alley and which is not trimmed to a height of twelve feet (12') above said alley or street.

    D.

    CONFLICTS

    Where the provisions of other Sections of these Building Regulations shall conflict with this section, the Code Enforcement Officer shall resolve the conflict.

    E.

    PENALTIES

    Any person, firm, or corporation who fails to comply with, or violates, any part of this section shall be subject to the penalties pursuant to Section 1 GENERAL (G) PENALTY, herein.
