§ 13. PAWNBROKERS

  • A.

    DEFINITIONS

    For the purpose of this section the following items are defined to have the following meanings:

    (1)

    Pawnbrokers shall mean any person whose business is to take or receive by way of pledge, pawn, or exchange any goods, wares, or merchandise, or articles of personal property of any kind as security for money loaned thereon.

    (2)

    Secondhand dealer shall mean any person engaged in the business of purchasing or selling goods of any kind or description, having once been used or transferred from the manufacturer to the dealer and then received into the possession of third parties, whether same consists of clothes, rags, iron or other metal, furniture, articles or household utensils, articles of personal use or wearing apparel, or jewelry of any kind or description, or old gold or silver, plumbing fixtures, secondhand building material, or any other goods of the class considered personalty, whether related to any of the goods above specifically described or not.

    B.

    REGISTER

    (1)

    Required

    Any and all persons engaged in business as a pawnbroker or secondhand dealer shall keep a register in connection with such business.

    (2)

    Daily Entries; Information Required

    At the close of business on each day the pawnbroker or dealer shall enter or cause to be entered therein the following:

    (a)

    Facts about Person

    An accurate description of the person, from whom any article of personal property is purchased or received or to whom any loan is made on personal property, which shall include the name, age, sex, color, nationality, and place of residence of such person, as well as their current driver's license number.

    (b)

    Facts about Article

    An accurate description of any article of personal property, so purchased or received or upon which a loan is made, which shall contain any mark, brand, monogram, word, or letters blown, stamped, etched, or otherwise permanently marked upon such article.

    (c)

    Photo of Person and Items

    Articles, not easily identified by description, namely silver and gold items, and all jewelry shall be photographed (polaroid) along with the person from whom article is purchased or received.

    C.

    STOCK ARRANGED FOR INSPECTION

    All articles purchased or received by pawnbrokers or secondhand dealers shall be so arranged in stock as to enable the same to be inspected by the police department or any other person in authority.

    D.

    INSPECTION

    (1)

    Register and Articles

    All entries made, as provided in subsection B, and all articles and items bought or obtained by any dealer, along with photograph when applicable, shall be open and subject to inspection and examination at all times by the chief of police or any officer or any other person authorized and designated by him to inspect the same.

    (2)

    Seven (7) Days after Purchase

    Such articles and items shall be kept by such dealer within the city for at least seven (7) days from the date of buying or receiving the same, for the purpose of inspection.

    E.

    LOCATION REQUIREMENT

    It shall be unlawful for any person to engage in the occupation of pawnbroker or secondhand dealer unless such business is conducted within a permanent building and is in full compliance with all public sanitation and health laws.

    F.

    LOCATION PROHIBITED IN PROXIMITY TO SPECIFIED BUILDINGS

    It shall be unlawful for any person to engage in the occupation of pawnbroker or secondhand dealer at any place or upon any premises in the city within one hundred feet (100') of any residence, apartment house, boarding or rooming house, hospital, hotel, church, or school, except the residence of a licensed pawnbroker or secondhand dealer.

    G.

    DEALING WITH MINORS

    It shall be unlawful for any pawnbroker or secondhand dealer to buy, take, or receive by way of pledge, pawn, or exchange any goods, wares, or merchandise or article of personal property of any kind from any person under the age of eighteen (18).

    H.

    ANNUAL LICENSE

    Any and all persons engaged in business as a pawnbroker or secondhand dealer within the city shall obtain a license from the city secretary. The annual license fee shall be twenty-five dollars ($25.00) unless such business is operated by a nonprofit group, in which case the fee shall be waived.
