§ 4. SALE OF BEER, WINE, AND OTHER INTOXICANTS

  • A.

    PERMIT REQUIRED

    It shall be unlawful for any person, firm, or corporation to sell or to possess for the purpose of sale within the City of Santa Fe, Texas, beer, wine, or distilled spirits, without first having obtained a permit therefor, authorizing such sale.

    B.

    PERMIT FEES

    The following schedule of permit fees shall apply for the permits required by this section:

    (1)

    Retail Dealer's Beer On-premises Permit ..... ½ state fee

    (2)

    Retail Dealer's Beer Off-premises Permit ..... ½ state fee

    (3)

    Wine and Beer Retailer's Permit ..... ½ state fee

    (4)

    Package Store Permit ..... ½ state fee

    (5)

    Wine Only, Package Store Permit ..... ½ state fee

    (6)

    Other ..... ½ state fee

    C.

    ENTITLEMENTS OF PERMITTEE

    The above and foregoing listed permit fees upon payment shall entitle the permittee to a permit to be issued by the city secretary designating the type permit issued, and shall authorize the permittee to sell the same intoxicants as are authorized for sale by the holders of a similar permit from the State of Texas.

    D.

    TERMS OF PERMIT

    The permits issued hereunder shall be issued by the city secretary upon payment of the permit fee and upon presentation by the applicant or permittee of a valid state permit issued for a period or part of the period for which the city permit is issued. The permits issued hereunder shall expire on December 31st of the year issued, and an annual permit shall be required. The permit fee for any permit issued hereunder for less than a year shall be prorated for that portion of the year extending from the date of issuance to December 31st of the year issued.

    E.

    PENALTIES

    Any person, firm, or corporation violating the terms hereof shall upon conviction, be fined not less than five dollars ($5.00) nor more than two hundred dollars ($200.00) and each day of violation shall be a separate offense.
