§ 1. FIRE CODE

  • A.

    STANDARD FIRE PREVENTION AND SAFETY CODES ADOPTED

    (a)

    There is hereby adopted for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code recommended by the International Code Council, known as the International Fire Code, 2012 edition thereof, and the whole thereof save and except such portions as are hereinafter deleted, modified or amended as prescribed in this section. One (1) copy of said code is on file in the office of the City Secretary, and the same is hereby adopted and incorporated as fully as if set out at length herein.

    (b)

    There is hereby adopted for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code known as the 2015 edition of the NFPA 101 Life Safety Code and the whole thereof save and except such portions as are hereinafter deleted, modified or amended as prescribed in this section. One (1) copy of said code is on file in the office of the City Secretary, and the same is hereby adopted and incorporated as fully as if set out at length herein.

    (c)

    Revisions:

    Amend 2012 edition of the IFC, Chapter 9 by deletion of Section 903.2.8 Group R. An automatic sprinkler system installed in accordance with Section 903.3 shall be provided throughout all buildings with a Group R fire area.

    Amend 2012 edition of the IFC, Chapter 9 Section 903.2.1.3 Group A-3. By adding the following: Exception: Bonafide 501C-3 (Non-Profit) activities are exempt from installing an automatic sprinkler system where there exists an inadequate public water system to support the required automatic sprinkler system; or where no adequate on-site storm water detention/capacity capable of supporting the required automatic sprinkler system exists; or where no adequate containerized water storage system is available to support the required automatic sprinkler system.

    B.

    CONFLICT

    In the event of a conflict between the provisions of the Fire Code adopted by reference in subsection "A" above and any other provision of this Code of Ordinances, the provisions of this Code of Ordinances shall prevail.

    C.

    ENFORCEMENT

    The provisions of said Fire Code shall be enforced by the City Fire Marshal or his designee.

    D.

    PERMIT, INSPECTION, INVESTIGATION, AND FEES

    The City Fire Marshal or his designee shall issue all City of Santa Fe, Texas, fire permits; perform all Fire Code inspections or investigations; and enforce the requirements associated with each of the following permits, inspections, and investigations; burn permit, recreational/ceremonial bonfires, re-inspections, work without a permit, fire suppression, change to existing suppression system, fire alarm systems, flammable and combustible storage tank removal, industrial burns, annual fire alarm and annual fire safety inspections for non-residential uses. Permit fees shall be established and determined by resolution of the City Council.

    E.

    APPEALS

    Any person, firm or corporation aggrieved by any decision of the City Fire Marshal shall have the right to make an appeal to the City Council. Such appeal shall be perfected by written notice submitted to the City Secretary and addressed to the Mayor and City Council requesting a public hearing by the City Council within ten (10) calendar days of the action in appeal. Decisions of the City Council thereon shall be final.

    F.

    PENALTY

    Any person, firm, or corporation who fails to comply with, or violates any provision of this section shall be subject to the penalties provided in Chapter 1, General Provisions, Code of Ordinances, Section 5, General Penalty for Violations of Code.
