§ 12. SKATEBOARDS AND SKATES RESTRICTED.

    DEFINITIONS:

    As used in this article, the following words and terms shall have the meanings ascribed to them in this section, unless the context of their usage clearly indicates another meaning:

    Skateboard. Any device propelled by human power upon which a person may ride, consisting of a short, oblong board with four (4) or more wheels, typically ridden in a standing position.

    Skates. A shoe, boot, or attachment with inline wheels located along its sole, or with a pair of small wheels located on the ends, use for gliding along a hard surface.

    B.

    SKATEBOARDING AND SKATING PROHIBITED IN CERTAIN AREAS.

    1.

    No person upon skates or riding by means of any coaster, skateboard, toy vehicle, or similar device shall go upon any public roadway, public sidewalk, or any other publicly-owned property within the boundaries of the City of Santa Fe, Texas, in areas where such conduct is posted as prohibited.

    2.

    No person upon skates or riding by means of any coaster, skateboard, toy vehicle, or similar device shall enter, go, travel, or skate in, on, or along the sides, walls, linings, or aprons of any storm sewer, storm drain, drainage outfall, drainage ditch channel, or drainage ways within the boundaries of the City of Santa Fe, Texas.

    3.

    No person upon skates or riding by means of any coaster, skateboard, toy vehicle, or similar device shall go upon any private property which skateboarding or skating has been prohibited by the owner of the property or the agent having control of such property, as indicated by a posted sign prohibiting such skateboarding or skating.

    C.

    RULES AND REGULATIONS.

    These regulations may be enforced by any public safety personnel, including but not limited to code enforcement officers and law enforcement personnel.

    D.

    VIOLATIONS; PENALTY.

    Any person who violates any provision of this section shall be guilty of a misdemeanor and, upon conviction, fined in accordance with Chapter 1, General Provisions, Code of Ordinances, Section 5, General Penalty for Violations of Code. Each violation shall constitute and be punishable as a separate offense.
